General terms and conditions of sale

1. Rental

The rental period runs from the day of arrival at 3 p.m. to the day of departure at 11 a.m. unless otherwise formally agreed by the campsite management. (for camping pitches, arrival can be from 2 p.m. and departure before 12 a.m.).

2. Balance

The balance of the stay must be paid by secure payment 21 days before the start of the stay for rentals and on the day of arrival for camping pitches.

3. Arrival

Customers must arrive on the date stipulated in the contract. If they have to delay their arrival, they must inform the campsite management. If we do not receive any information in this regard, the accommodation will remain free until 12.00 noon on the following day and may be allocated to another customer.

4. Deposit (for rentals)

Once you have visited the property, taken possession of your rental and checked the inventory, you will be asked to leave a deposit of €280 as a guarantee (€200 to cover any damage caused to the rental property and €80 to cover any insufficient cleaning of the rental property on your departure). The security deposit will be returned on departure after an inspection of the rented premises by the person in charge during normal opening hours at the reception desk, or within a week after deduction of any costs incurred in restoring the rental property. No interest will be charged on the deposit.

5. Stay

The rental contract is personal and may only be transferred to a third party with the agreement of the campsite management. The customer and the occupants of the accommodation must comply with the campsite's internal regulations (a copy of which can be sent to you on request), in particular: additional person(s) are only admitted with the agreement of the management and at a price indicated on the rental price list. Customers are responsible for all damage caused by them. They are advised to check that their personal insurance covers them for holiday use. If this is not the case, you are strongly advised to take out such insurance.

6. Visitors

After registering at reception, visitors must pay a fee, displayed at the reception desk, according to their use of the campsite's services.

7. Changes

In the event that the holiday is modified in any essential way by the manager, the customer may, within 7 days of being notified: either cancel the booking and recover the full amount paid, or agree to take part in the modified holiday by signing an amendment to the contract specifying the changes made and the reduction or increase in price that these would entail.

8. Interruption of stay

You must notify the campsite management immediately. The conditions applicable to this interruption are listed in the general conditions of sale below.

10. Complaints or disputes

They must be sent by registered letter to the head office and will, after consultation with the mediator, fall under the exclusive jurisdiction of the Commercial Court of La Rochelle.

11. Personal information

The personal information that Camping La Brande will be required́ to process, and concerning you, results from your approach with a view to making a reservation with our establishment, or with a view to you receiving documentation. This information is neither sold nor communicated to third parties and is strictly reserved for internal use by the campsite. It is processed in accordance with the RGPD.

Appendix: General terms and conditions of sale

Like any contract, this one includes reciprocal rights and obligations. These rights and obligations are set out below. The general terms and conditions of sale take effect on the date on which the present contract is signed and expire on the day of departure from the campsite.

HOW LONG IS THE CONTRACT VALID FOR? The contract is valid for the duration of the services sold by the campsite.

WHAT DO WE GUARANTEE? Standard rate: This rate does not include a refund in the event of cancellation. Flexi rate: With the exception of cancellation charges (€30), we guarantee a refund of the sums paid up to 21 days before the date of arrival, without the need for a supporting document. Between the 20th day before your arrival and the end of your stay at the campsite, and provided you have supplied proof, you will be entitled to a refund. If the tenant is unable to enjoy his stay for one of the reasons listed below: The guarantee provides for reimbursement to the tenant of the sums paid by him/her and due under this contract, excluding cancellation costs (€30).

WHEN DO WE INTERVENE? We intervene in the cases and circumstances listed below, to the exclusion of all others.

SERIOUS ILLNESS, SERIOUS ACCIDENT OR DEATH (including relapse, aggravation of a chronic or pre-existing illness, as well as the consequences of an accident that occurred prior to taking out the policy): Yourself, your legal or de facto spouse; Your ascendants or descendants to the 2nd degree, and/or those of your legal or de facto spouse; Your brothers, sisters, brothers-in-law, sisters-in-law, sons-in-law, daughters-in-law; In the event of the death of your uncle, aunt, nephews and nieces; Your professional replacement, provided that his/her name is mentioned when the policy is taken out The legal guardian of a person usually living under your roof, the person responsible during your trip for looking after your minor children, the person responsible for looking after a disabled person, if you are the legal guardian. We will only intervene if the illness or accident formally prevents you from leaving your home, requires medical care and prevents you from carrying out any professional or other activity.

  • COMPLICATIONS DUE TO PREGNANCY Which entail the absolute cessation of all professional or other activity and provided that, at the time of departure, the person is not more than 6 months pregnant, or if the very nature of the trip is incompatible with your state of pregnancy, provided that you were not aware of your condition when you booked the trip.
  • CONTRAINDICATION AND FOLLOW-UP TO VACCINATIONECONOMIC LICENCIATION / TERMINATION OF AGREEMENT By yourself, your spouse or your de facto spouse, provided that this decision is not known at the time of booking the holiday.
    Summons to appear before a court of law, ONLY IN THE FOLLOWING CASES: Jury or witness at an Assizes, appointment as an expert, whether you are summoned on a date coinciding with the period of the holiday.
  • INVITATION TO ADOPT A CHILD: Provided that you are invited to attend on a date that coincides with the period of your stay.
  • INVITATION TO A RETEST EXAMINATION: Following a failure unknown at the time of booking or taking out the policy (higher education only), provided that the examination takes place during the holiday.
  • DESTRUCTION OF BUSINESS OR PRIVATE PREMISES: as a result of fire, explosion or water damage, provided that the said premises are more than 50% destroyed.
  • THEFT FROM BUSINESS OR PRIVATE PREMISES: Provided that the extent of the theft requires your presence and that the theft occurs within 48 hours of departure.
  • SERIOUS DAMAGE TO YOUR VEHICLE: In the 48 hours prior to departure and provided that the vehicle cannot be used to get you to your holiday destination.
  • GRANT OF A JOB OR INTERNSHIP BY POLE EMPLOI: Provided that the person is registered as a job seeker with Pôle Emploi and that the job or internship starts before or during the trip. Modification of the type of employment contract is not guaranteed (e.g. transformation of a fixed-term contract into a permanent contract).
  • DELETION OR CHANGE OF DATES OF PAID LEAVE DUE TO THE EMPLOYER: Granted in writing before registration for the trip, excluding company directors, self-employed professionals, craftsmen and entertainers.
  • PROFESSIONAL TRANSFER: Imposed by your hierarchy and not requested by you, with the exception of company managers, self-employed professionals, craftsmen and entertainers.
  • VISA REFUSAL BY THE AUTHORITIES OF THE COUNTRY: Provided that no application has previously been refused by these authorities for the same country. Proof from the embassy will be required.
  • NATURAL DISASTERS (IN THE MEANING OF LAW No. 86-600 OF 13 JULY 1986 AS AMENDED): Occurring at the holiday location, leading to a ban on staying at the site (town, district, etc.) by the local or prefectural authorities for all or part of the period specified in the booking contract, and occurring after the present contract has been taken out.
  • BAN ON THE SITE: (Municipality, district, etc.) within a five-kilometre radius of the holiday location, by the local or prefectural authorities, following sea pollution or an epidemic.
  • SEPARATION (PACS OR MARRIAGE): In the event of divorce or separation (PACS), provided that the proceedings were brought before the courts after the trip was booked and on presentation of an official document.

CANCELLATION OF THE PEOPLE ACCOMPANYING YOU: (Maximum 6 people) registered at the same time as you and insured under the same contract, when the cancellation is due to one of the causes listed above.

WHAT ARE THE GENERAL EXCLUSIONS APPLICABLE TO ALL OUR COVER? We cannot intervene when your claims for cover or benefits are the consequence of damage resulting from : Epidemics, natural disasters and pollution. Civil or foreign war, riots, civil commotion or strikes; Voluntary participation by an insured person in riots or strikes; Disintegration of the atomic nucleus or any irradiation resulting from ionising radiation; Alcoholism, drunkenness, the use of drugs, narcotics or medication not prescribed by a doctor; Any intentional act that may lead to the policy being covered and any consequences of criminal proceedings against you; Duels, bets, brawls (except in self-defence); The practice of the following sports: bobsleigh, skeleton, mountaineering, competitive luge, aerial sports with the exception of parasailing, as well as those resulting from participation or training in official matches or competitions organised by a sports federation. Suicides and the consequences of attempted suicides The absence of a hazard. Illness requiring psychological or psychotherapeutic treatment, including nervous breakdowns that have not required hospitalisation for at least 4 days at the time the holiday is cancelled. Failure to take vaccinations. Failure to present an identity card or passport for any reason whatsoever. Illnesses or accidents first diagnosed, relapsed, aggravated or hospitalised between the date on which the holiday was booked and the planned date of arrival, Default of any kind, including financial default, on the part of the organiser of your holiday or the carrier, making it impossible to fulfil its contractual obligations. Furthermore, we will never intervene if the person causing the cancellation is hospitalised at the time the holiday is booked or the contract is taken out.

HOW MUCH DO WE COVER? We will cover the amount of the sums paid on the day of the event that may trigger the guarantee, in accordance with Camping La Brande's general terms and conditions of sale.

HOW LONG DO YOU HAVE TO REPORT A CLAIM? Medical reasons: you must declare your claim as soon as it is established by a competent medical authority that the seriousness of your state of health is such as to contraindicate your trip. For any other reason for cancellation: you must declare your claim as soon as you become aware of the event that may trigger cover.

HOW LONG WILL IT TAKE TO RECEIVE COMPENSATION? Payment will be made within fifteen days of the agreement reached between us.

WHAT ARE THE PENALTIES FOR INTENTIONAL MISREPRESENTATION ON YOUR PART AT THE TIME OF THE CLAIM? Any fraud, concealment or intentional misrepresentation on your part concerning the circumstances or consequences of a claim will result in the loss of all rights to benefits or compensation for this claim.
